Life Technologies has lost the latest round in a battle with its Indian namesake over trade marks and domain names.

In India, these trade marks and domain names are owned and used by Life Technologies India Private Limited (LTIPL).
LTIPL was established in 2002 and soon after acquired ATZ Lab Solutions, the Indian business of the US company Invitrogen, which subsequently merged with fellow US company Applied Biosystems in 2008 to become Life Technologies. Rather confusingly, Invitrogen acquired an earlier version of Life Technologies in 2000 and discontinued the name, before resurrecting it following the merger with Applid Biosystems.

In 2011, Life Technologies approached LTIPL about purchasing or seeking a license to use the ‘Life Technologies’ trade mark in India and to gain control of some of the domain names, but LTIPL declined the offer. So Life Technologies then launched an injunction against LTIPL in the High Court of Delhi to prevent it from using the two trade marks and the five domain names.

After nearly 20 months of hearings, the High Court of Delhi has now dismissed Life Technologies’ application, after LTIPL produced evidence to prove that it has owned the trade marks and domain names for over 10 years. The High Court also held that the fact Life Technologies initially approached LTIPL to acquire the rights to some of the trade marks and domain names shows that Life Technologies accepted they were assets owned by LTIPL.
